{"id":1966,"date":"2023-02-28T15:20:38","date_gmt":"2023-02-28T15:20:38","guid":{"rendered":"https:\/\/nativoqueretaro.mx\/?p=1966"},"modified":"2023-02-28T15:20:38","modified_gmt":"2023-02-28T15:20:38","slug":"propone-penas-y-sanciones-para-quienes-hagan-cobranza-extrajudicial","status":"publish","type":"post","link":"https:\/\/nativoqueretaro.mx\/index.php\/2023\/02\/28\/propone-penas-y-sanciones-para-quienes-hagan-cobranza-extrajudicial\/","title":{"rendered":"Propone penas y sanciones para quienes hagan cobranza extrajudicial"},"content":{"rendered":"<table role=\"presentation\" border=\"0\" width=\"100%\" cellspacing=\"0\" cellpadding=\"0\" align=\"center\">\n<tbody>\n<tr>\n<td id=\"m_-7510762570134803565bodyText-12\">Lucrar con la necesidad de los ciudadanos en momentos de crisis financiera, es algo que no se puede permitir por los abusos que se cometen para cobrar una<\/p>\n<p>deuda, se\u00f1al\u00f3 el diputado federal JerIc\u00f3 Abramo Masso, por lo cual present\u00f3 una iniciativa que plantea sancionar de uno a cuatro a\u00f1os de prisi\u00f3n y multa de cincuenta mil a trescientos mil pesos a quien lleve a cabo la actividad de cobranza extrajudicial ilegal.<\/p>\n<p>En su fundamentaci\u00f3n, el integrante del Grupo Parlamentario del PRI expuso que, desde el 2018, se observ\u00f3 que el cr\u00e9dito informal ha crecido con mayor rapidez que el cr\u00e9dito formal. Aunado, indic\u00f3, a la situaci\u00f3n econ\u00f3mica nacional que ha llevado a muchas personas a situaciones de sobregasto para cubrir sus compromisos.<\/p>\n<p>Puntualiz\u00f3 que en este contexto surgieron una serie de aplicaciones digitales que ofrecen pr\u00e9stamos con montos que van desde los 500 hasta los 20 mil pesos o m\u00e1s, que se ofrecen a trav\u00e9s de redes sociales, como Facebook, Instagram, o Twitter, as\u00ed como volantes y anuncios de ocasi\u00f3n, de los que el gobierno federal ha identificado m\u00e1s de 660 aplicaciones.<\/p>\n<p>El legislador priista explic\u00f3 que el atractivo es la rapidez para obtener los recursos v\u00eda trasferencia electr\u00f3nica, motivo por el cual esta modalidad de pr\u00e9stamo y extorci\u00f3n, conocida como \u201cmontadeudas\u201d, han tenido un crecimiento exponencial. Adem\u00e1s, el solicitante acepta el acceso a sus contactos, galer\u00edas fotogr\u00e1ficas y en general a la informaci\u00f3n privada que se encuentra en su celular.<\/p>\n<p>Precis\u00f3 que esta situaci\u00f3n se agrava porque las aplicaciones generan un modelo de cobro de inter\u00e9s diario que supera las tasas que las instituciones reguladas aplican al otorgar un cr\u00e9dito, motivo por el cual peque\u00f1as cantidades se ven multiplicadas. Se suma que estas operaciones no se encuentran reguladas por la Comisi\u00f3n Nacional Bancaria y de Valores, ni cumplen con los requisitos se\u00f1alados en la Ley de Instituciones de Cr\u00e9dito.<\/p>\n<p>El diputado por Coahuila se\u00f1al\u00f3 que el problema es que el monto de la deuda del pr\u00e9stamo que solicitaron, se vuelve para las personas impagable. Esto, anot\u00f3, da paso a la extorsi\u00f3n y cobranza ilegal, al amenazar al deudor con exhibir sus fotograf\u00edas o llamar a sus contactos para cobrarles y difamarlas.<\/p>\n<p>Es por ello que en su propuesta para modificar el cuarto p\u00e1rrafo del art\u00edculo 284 Bis del C\u00f3digo Penal Federal, adem\u00e1s de la pena y multa que se propone aplicar, se subraya que se entiende por Cobranza Extrajudicial Ilegal, el uso de la violencia o la intimidaci\u00f3n, ya sea personalmente o a trav\u00e9s de cualquier medio, para requerir el pago de la deuda.<\/p>\n<p>Aclara que esta acci\u00f3n puede derivar de actividades reguladas y no reguladas en leyes federales, incluyendo cr\u00e9ditos o financiamientos que hayan sido otorgados originalmente por personas dedicadas a esta actividad, pero, se excluye, que no se considerar\u00e1 como intimidaci\u00f3n il\u00edcita informar aquellas consecuencias posibles y jur\u00eddicamente v\u00e1lidas del impago o la capacidad de
