{"id":1549,"date":"2023-02-20T19:13:06","date_gmt":"2023-02-20T19:13:06","guid":{"rendered":"https:\/\/nativoqueretaro.mx\/?p=1549"},"modified":"2023-02-20T19:45:45","modified_gmt":"2023-02-20T19:45:45","slug":"reformas-al-codogo-civil-para-que-menores-de-eadad-con-hijos-fuera-del-matrimonio-les-puedan-dar-su-apellido","status":"publish","type":"post","link":"https:\/\/nativoqueretaro.mx\/index.php\/2023\/02\/20\/reformas-al-codogo-civil-para-que-menores-de-eadad-con-hijos-fuera-del-matrimonio-les-puedan-dar-su-apellido\/","title":{"rendered":"Reformas al &#8220;C\u00f3digo Civil&#8221; para que menores de edad con hijos fuera del matrimonio les puedan dar su apellido"},"content":{"rendered":"<p><span style=\"font-weight: 400\">Para facilitar el trabajo de los jueces del Registro Civil, en el sentido del reconocimiento de hijos fuera de matrimonio, y cuyos padres sean menores de edad, la legisladora local Maricruz Arellano Dorado, present\u00f3, la iniciativa para reformar el art\u00edculo 349 del \u201cC\u00f3digo Civil del Estado de Quer\u00e9taro\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Explic\u00f3 que actualmente el art\u00edculo 349, es ambiguo con relaci\u00f3n al reconocimiento de los hijos nacidos fuera del matrimonio, ya que su lectura advierte que los progenitores que desean realizar el reconocimiento de sus hijos, no cuentan con par\u00e1metros y lineamientos espec\u00edficos para llevar a cabo ese acto jur\u00eddico, cuando son menores de edad y se presta a\u00a0 una mala interpretaci\u00f3n.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Arellano Dorado, coment\u00f3 que el prop\u00f3sito de esta reforma es darle claridad a dicha disposici\u00f3n y evitar interpretaciones err\u00f3neas por parte de las autoridades administrativas del Registro Civil, asegurando as\u00ed\u00a0 derecho a los hijos nacidos fuera del matrimonio a ser reconocido por su padres, creando en estos obligaciones y deberes\u00a0 familiares y sociales sobre los hijos reconocidos;\u00a0 adem\u00e1s de garantizar a los hijos el derecho humano a la identidad reconocido por el art\u00edculo 4 de la Constituci\u00f3n Pol\u00edtica de los Estados Unidos Mexicanos.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Con las modificaciones al 349, todos los padres menores de edad con hijos fuera del matrimonio, podr\u00e1n dar su apellido a sus hijos, presentando una carta con el consentimiento de sus padres al momento de presentarse para hacer el registro, aclar\u00f3.<\/span><span style=\"font-weight: 400\">\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Hasta hoy, en estos casos, el menor adquiere los apellidos solamente de la madre y queda fuera la figura paterna en lo legal, especific\u00f3.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Para facilitar el trabajo de los jueces del Registro Civil, en el sentido del reconocimiento de hijos fuera de matrimonio, y cuyos padres sean menores de edad, la legisladora local Maricruz Arellano Dorado, present\u00f3, la iniciativa para reformar el art\u00edculo 349 del \u201cC\u00f3digo Civil del Estado de Quer\u00e9taro\u201d.
